Terms of Service

1. Acceptance of Terms
By accessing or using Jobsy ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. The Platform is operated by Jobsy Ltd., a company registered in Jamaica.
2. Description of Service
Jobsy is a marketplace that connects customers (hirers) with service providers across Jamaica through a competitive bidding and digital contract system. Customers post jobs describing the work they need done, providers submit bids with their price and proposal, and the customer selects the winning bid. A legally binding digital contract is generated and signed by both parties before work begins. Jobsy does not itself provide any services and is not a party to the contract between providers and customers.
3. User Accounts and Roles
You must create an account to use the Platform. Users can switch between two roles: Customer (hirer) and Provider. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate and complete information when creating your account.
4. Job Posting and Bidding
Customers may post jobs describing the work needed, including budget, deadline, and location. Providers may submit bids on open jobs. Each provider may submit one bid per job. The customer may accept, reject, or shortlist bids at their discretion. When a bid is accepted, all other bids for that job are automatically rejected. Providers with active contracts on overlapping dates will be blocked from bidding.
5. Digital Contracts
When a bid is accepted, Jobsy automatically generates a digital contract. Both the customer and provider must sign the contract within 48 hours. If either party does not sign within this period, the contract expires and the job is re-opened for new bids. Signed contracts are legally binding under Jamaica's Electronic Transactions Act, 2006. The contract includes the agreed price, scope of work, timeline, and cancellation terms.
6. Payments and Platform Fee
All payments must be made through the Jobsy platform. A platform fee of 5% is deducted from the contract amount upon completion. Contracts are only enforceable when all payments are processed through Jobsy. Payments made outside the platform (cash, bank transfer, or any other method) void all platform protections, dispute resolution, and contractual guarantees. Payments are processed securely through NCB Jamaica.
7. Milestones and Completion
Contracts may include milestones defined during the bidding process. Providers mark milestones as complete, and customers review and approve them. When all milestones are approved, the contract is automatically marked as complete. Either party may raise a dispute on any milestone through the platform.
8. Cancellation
Either party may request cancellation of a contract through the platform. The other party must approve the cancellation request. Cancellation fees as specified in the original bid terms may apply. Approved cancellations result in the contract and job being marked as cancelled.
9. Service Providers
Service providers are independent contractors, not employees of Jobsy. Providers are responsible for the quality of their services, compliance with applicable Jamaican laws, and payment of any applicable taxes including NIS contributions. Jobsy reserves the right to verify provider identities and may remove providers who do not meet quality standards.
10. Reviews
Users may leave reviews after a contract is completed. Reviews must be honest, accurate, and based on genuine experiences. Only users who completed a contract can leave reviews. Jobsy reserves the right to remove reviews that violate our guidelines.
11. Prohibited Conduct
Users must not: (a) use the Platform for any unlawful purpose; (b) harass, abuse, or threaten other users; (c) post false or misleading information; (d) attempt to circumvent platform fees by arranging payments outside Jobsy; (e) submit fraudulent bids; (f) scrape or collect data from the Platform without permission; or (g) impersonate another person or entity.
12. Limitation of Liability
Jobsy is not liable for any disputes between service providers and customers, the quality of services provided, or any damages arising from the use of the Platform. Our liability is limited to the platform fees paid to Jobsy for the specific contract in question.
13. Governing Law
These Terms of Service are governed by the laws of Jamaica. Any disputes arising from these terms shall be resolved in the courts of Jamaica.
